Question By law,who would be at fault?

Ok so I come home from the gym today and was messing with the dogs. my husband comes out saying how the neighbors 2 border collies were trying to jump our fence to get into our yard.Now mind you its about 5 foott tall picket fence.I was like oh.Now we just moved Rage my bitch onto what we call the mound.its a very small inclined hill if that.So miss neighbor comes out to have a talk with him.Now mind you I was not home when this was happening.She goes on to tell him how her dogs are just curious about my dogs and that we should have them meet?!! He was like lady your out of your mind.So then after he goes inside she is yelling at me from out her window the same conversation she had with him.I told her she better watch her dogs.

So my question is IF by chance her dogs did jump my fence and Rage did her thing.Whos fault would it be? This neighbor is allways introuble with the dog officer.Her dogs allways getting out and crap.

By law probably hers but a 5 foot picket fence is not a fence youshoudl have with pit bulls the fence shoudl be a sturdy 6 foot fence and you as a pit bull owner need to make sure your dog cant get out and nothing can get in, because the neighbors will see bad pit bulls who killed a border collie who wanted to play. Get a better fence and dont ever leave the dogs unattended if you think something can get in.

You need to make sure Rage cant do her thing to any animals or it will be trouble for you and irresponsible to boot

Rage is contained on a chain.the fence might be alittle of 5 feet.i'll have to measure it .

yeah he's right listen to him. The law would be on your side if her dogs come in your yard, but the blame as far as the public goes would be the pit bulls.
And don't let the cute border collies fool you, my old friends bit people, and her pit bull kissed people.

It is the neighbors fault if her dogs come onto your property and get hurt. Just to be on the safe side call your local AC and put a report and you want it notes that her dogs are always out and trying to get in your yard and you are worried one day they will. Tell the AC that you have a DA dog (you do not have to say the breed) and you do not want to be responsible if your dog hurts that dog if they jump your fence.

I just had a similar thing happened here, AC knows me very well but i did call and have them make a report of my neighbors labs who were getting on my property and messing up my 6 foot chain link. I told them that if I was letting Dixie out to her run and those dogs got on my property they would probably get killed. AC agreed it would not be my fault and went and talked to the owners but this had happened several times not just once. If you are proactive about it and something does happen you are covered. JMO

Ok I will make a call first thing Monday morning to ac.Plus hubby will be going to the feed store to put up a hotwire ontop of the fence. As said before these dogs have been reported to ac many times from jumping there own fence and running around chaseing people to barking all night when the owners leave the dogs unattened.

I would advice a sign saying you have a dangerous dog. That way if by chance someone tried to break into your home or a dog got into your yard its the owners fault. Be sure to have the sign clearly posted. Maybe one on each side of the house. I know it may look trashy but it will save your from a law suit.

If the dogs did jump the fence and you did not have these signs I am sure that it is her fault for not containing her dogs.
I would advice typing up a letter or writing it and signing it and sending it over to her telling her that you are worried that if her dogs do jump the fence that you are worried that your dog might attack. This will add to your case if you do go to court. Be sure to have a copy saved.

I have written out a letter myself to someone who had a dog running loose when I was staying at my grandmas. I told them in the letter that people were going to be in and out looking at the house that may be going up for sale and if they see the dog...well you know what that doesnt matter

Type or write a letter saying what you are worried about. and place it in her door...can get in trouble if placed in her mail box...silly mail people. If her dogs then do jump the fence you can take her to court or if she takes you to court you have proof that you have a sign saying there is a dangerous dog((even though it may be friendly)) its a safety thing...did it with my aunt and uncles bull mastiff...sweetest thing...though no one can call them out because they had signs that the dog was dangerous...so it covered them.
Please the note in the letter stating that you have seen her dogs trying to get at your dog and your worries will help you in a case

I agree posting signs of dangerous dogs make it look like you knowingly have dogs that wold harm any thing and anyone. I would try just talking to her kindly if this was the first time shes brought it up and explain to her why it is not a good idea.

The only problem is that Border Collies can't read and a No Trespassing sign only works for people, not dogs. There isn't really a sign that help with this situation.

I am wondering though, what the laws are in your area. In the city I live in "potentially dangerous dogs"(which is what pit bulls are deemed here) have to be contained within a fenced yard and the fence must be at least 6'. Also there is a law here against tethering so you may want to check on that before mentioning that to AC.

It doesnt even have to say dangerous dog. It could simply be one of those signs that says pit bull on guard.

I dont see how it would be used against you. You have come to know what your dog can do some damage, and you have let the others know that there is a dog back there.


Also be sure to add in if there are breaking points in the fencing because of the neighbors dogs

Was out this morning cutting the grass and checking the fence for weak spots.there are none.But i cant even check near the fence without her dogs coming barrelling towards the fence.I'll take some pictures so you guys can see.As for the laws for tethering ect.There really is none.Shes on a 14 foot chain anyways and i measured the fence lastnight and its a few inches shy of 6 feet.Hubby thought about puting up a thing that says security dog on premise or something to that.

Very good idea. There is laws here as well on no tethering and how high your fence must be(6 feet). we do have a Sign in the window saying. Pitbull security company with a pic of a APBT on it I just don't want people being afraid of my dogs. But they do need to know they are there.
